Terms Of Service

Account

You must be 13 years or older to use this Service. You must provide your full legal name, a valid email address, and any other required information to complete the sign-up process. You are responsible for maintaining the privacy and security of your account. Church Podcast will not be held liable for any damages or losses that may result from your failure to protect your login information, including your password. You may not use our service for any illegal purpose or to violate any laws in your jurisdiction including but not limited to copyright laws. Accounts registered by “bots” or other automated methods are not permitted and one person may not maintain or signup for more than one free account.

You alone are responsible for the proper cancellation of your account. You may cancel your account at any time by clicking on Close Account button in the Account Billing page `more` navigation menu. This provides a simple link to cancel your account at any time. Email or phone requests to cancel your account will not be deemed as cancellation. Your account and all of its content will be deleted within 3 to 6 months upon cancellation of the Service. This information can NOT be recovered once it has been deleted. You can cancel at any time, but you will remain liable for all charges accrued up to that time, including full monthly charges for the month which you discontinued service. You will not be charged again. Church Podcast reserves the right to modify, suspend, or terminate your account and refuse any and all current or future use of the Service for any reason at any time with or without notice or refund. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all content in your account. Church Podcast may refuse service to anyone for any reason at any time.

Billing and Payment

A valid credit card is required for paying accounts. A credit card is not required to create or use a free account. The Service is billed in advance for each month or year (depending on your billing cycle), and is non-refundable, unless stated otherwise all prices are in United States Dollars (USD). There will be no refunds or credits for partial months of service. Should you update your billing cycle, your credit card will be charged the billing rate immediately and will then be charged your new billing rate plus any overage fees on a monthly/yearly (depending on your billing cycle you choose) basis. Should you update your account plan between billing cycles, if you choose to be billed yearly, your credit card will be charged the billing rate immediately and will then be charged your new billing rate plus any overage fees on a yearly basis. You will continue to be charged until you change to the free plan or cancel your account. All fees are exclusive of all taxes or duties imposed by governing authorities. You alone are responsible for payment of all such taxes or duties. Church Podcast reserves the right to modify, suspend, or discontinue the Service at any time for any reason with or without notice. Church Podcast reserves the right to change our monthly fees upon 30 days notice from us. Fee change notices may be posted to the Service or on the Church Podcast website. Church Podcast shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service. You can set your subscription via your Account Billing page by selecting your desired subscription tier. You may modify your subscription tier or cancel your subscription at any time via your Account Billing page.

Church Podcast offers a One Podcast, Unlimited Podcast and Enterprise hosting plans. The One Podcast and Unlimited Podcast plans, listed on our site www.churchpodcast.rocks/pricing, are not intended for high bandwidth utilization. Church Podcast may, at its discretion, request accounts utilizing a high volume of outbound bandwidth be moved to the Church Podcast Enterprise plan. High Bandwidth Podcasts are typically defined by exceeding 500 gigabytes of outbound transfer within 30 days. The Church Podcast Enterprise Podcast plan is billed at $50 per month and allows up to 1 TB of outbound data transfer. Outbound bandwidth exceeding 1 TB will be billed at $40 per terabyte.

Copyright and User Content

You are responsible for all content such as podcast content, photos, images, videos, graphics, written content, audio files, code, information, or data uploaded, collected, generated, stored, displayed, distributed, transmitted or exhibited on or in connection with your Account. You assume all risks associated with use of your User Content, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure of your User Content that personally identifies you or any third party. You hereby represent and warrant that your User Content does not violate our Acceptable Use Policy (defined in below). You may not represent or imply to others that your User Content is in any way provided, sponsored or endorsed by Church Podcast. Because you alone are responsible for your User Content, you may expose yourself to liability if, for example, your User Content violates the Acceptable Use Policy. Church Podcast is not obligated to backup any User Content, and your User Content may be deleted at any time without prior notice. You are solely responsible for creating and maintaining your own backup copies of your User Content if you desire. We do not claim any intellectual property rights over the User Content. All User Content you upload remains yours. Except for the rights granted in this term, Church Podcast is not acquiring any right, title or interest in or to your User Content. You can remove the User Content at any time by deleting such User Content or deleting your Account. You hereby grant to Church Podcast the right to allow the Services to use the processor, bandwidth, and storage hardware on your device in order to facilitate the operation of the Services. You hereby grant (and you represent and warrant that you have the right to grant) to Church Podcast a nonexclusive, royalty-free and fully paid, worldwide license to use, edit, modify, aggregate, reproduce, distribute, display, and perform the User Content, and to grant sublicenses of the foregoing rights, in connection with the operation of the Services, the promotion, advertising or marketing of the Services, and the operation of Church Podcast’s business. You hereby irrevocably waive (and agree to cause to be waived) any claims and assertions of moral rights or attribution with respect to your User Content. As it relates to distribution of your podcast to third-parties, Church Podcast has no direct control over the third party selection or approval process and makes no warranties with regard to the submission of User Content for distribution.

Privacy and Confidentiality

Church Podcast respects the privacy of its users. Please refer to our Privacy Policy, which explains how we collect, use, and disclose information that pertains to your privacy. When you access or use the Site, you show that you agree to this Privacy Policy.

Acceptable Use Policy

You will not post information that is malicious, false or inaccurate. You will not submit any User Content that may be deemed as pornography, defamatory, libelous, obscene, harassing, threatening, incendiary, abusive, racist, offensive, deceptive or fraudulent, encouraging criminal or harmful conduct, or which otherwise violates the rights of Church Podcast or any third party (including any intellectual property rights, privacy rights, contractual or fiduciary rights). You will not submit User Content that is copyrighted or subject to third party proprietary rights, including privacy, publicity, trade secret, etc., unless you are the owner of such rights or have the appropriate permission from their rightful owner to specifically submit such User Content, or unless your use of the content is within the scope of fair use; You will not use the personal data of any individuals that did not consent on such use, and you will comply with all your obligations as data controller of the personal data you use (under any applicable rules, including the European General Data Protection Regulation), accepting sole liability for any data protection breaches and agreeing to indemnify us, and hold us harmless, for any claim made against us on the grounds of a data protection violation committed by you or in relation to your User Content; Complying with your obligations as data controller include using personal data of third parties only for lawful purposes, obtaining express consent or relying on other available processing grounds; ensuring the accuracy and correctness of the data you share; comply with any requests from the data subjects to access, correct and remove any such data; comply with security obligations. Church Podcast is not responsible for any public display or misuse of your User Content. Church Podcast does not, and cannot, pre-screen or monitor all User Content. However, at our discretion, we, or technology we use, may monitor and/or record your interactions with the Site. Please refrain from using personal data of third parties in your content if you cannot ensure compliance with the applicable laws. You understand and agree that any liability, losses or damages that occurs as a result of the use of any User Content that you make available or access through your use of the Site is solely your responsibility.

API Terms of Use

Church Podcast reserves the right to modify, expand, or terminate API services at any time for any or no reason. By using this API, you acknowledge and agree to the following terms. The availability and the terms upon which it is available are continually under experimentation. Church Podcast may suspend or terminate your access to the API or might change any of its API specifications, protocols, or methods of access for any or no reason and will bear no liability for such decisions. It is solely your responsibility at all times to be prepared to manage your accounts and conduct your business without access to the Church Podcast API. Church Podcast does not represent or warrant, and specifically disclaims that the Church Podcast API will be available without interruption or without bugs.

General Terms

Your use of the Service, including any content, information or functionality contained within it, is provided "as is" and "as available" with no representations or warranties of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You assume total responsibility and risk for your use of this Service. Technical support is only provided via email. You understand that Church Podcast uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service. You agree not to resell, duplicate, reproduce or exploit any part of the Service without the express written permission of Church Podcast. You must not modify, adapt or hack the Service. Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Service customer, Church Podcast employee or officer will result in immediate account termination. You may not use the service to store, host, or send unsolicited email (spam) or SMS messages. You understand that the Service can be used for transmission of your Content, and that during processing, your Content, including Audio files, Video files, File meta data, users names, email addresses and passwords, may be transferred unencrypted over the internet. You may not use the service to transmit any viruses, worms, or malicious content.

Church Podcast makes no warranties regarding (i) your ability to use the Service, (ii) your satisfaction with the Service, (iii) that the Service will be available at all times, uninterrupted, and error-free (iv), the accuracy of mathematical calculations performed by the Service, and (v) that bugs or errors in the Service will be corrected. Church Podcast, its affiliates and its sponsors are neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to your use of the Service. Your sole remedy for dissatisfaction with the Service is to stop using the Service. If any provision of the Terms of Service is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby. The failure of Church Podcast to exercise any right provided for herein shall not be deemed a waiver of any right hereunder. The Terms of Service sets forth the entire understanding between you and Church Podcast as to the Service and supersedes any prior agreements between you and Church Podcast (including, but not limited to, prior versions of the Terms of Service). Your Agreement

You acknowledge that you have read these terms, understand the terms, and will be bound by these terms. You further acknowledge that these terms together with the privacy policy represent the complete and exclusive statement of the agreement between us and that it supersedes any proposal or prior agreement oral or written, and any other communications between us relating to the subject matter of this agreement
